Terms of Service - Spence AI Expense Tracker

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Spence ("Application," "we," "us," or "our") governing your access to and use of the Spence mobile application on Android.

By downloading, installing, or using Spence, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not install or use the Application.

2. Nature of the Application & Financial Disclaimers

⚠️ Important Financial Notice: Spence is an informational personal budgeting and expense tracking utility. Spence does NOT provide certified financial, investment, legal, or tax advice. We do NOT operate as a bank, credit provider, money transmitter, or custodian.

No Real Money Transactions: Spence calculations (such as Family Debt Simplification and Split Balances) are purely mathematical aids. Spence does not initiate, handle, or escrow monetary transfers.
AI Estimations & Forecasts: Daily Safe-to-Spend run rates, predictive cashflow alerts, and AI Copilot responses are computational projections based on your recorded transactions and cannot guarantee future financial performance.

3. Monetization, Subscriptions & In-App Purchases

Spence offers free Genesis features along with optional premium membership plans:

Spence Pro: $3.99/month or $29.99/year (includes AI itemizer, Gemini copilot, predictive cashflow, subscription radar, and PDF statements).
Spence Family: $6.99/month or $49.99/year (includes all Pro features for up to 6 members with automated debt simplification).
Spence Lifetime Pro: $79.99 one-time in-app purchase (perpetual access without recurring fees).

Billing & Cancellation

All subscription payments are processed securely through Google Play Billing. Subscriptions automatically renew at the end of each period unless canceled at least 24 hours prior to the billing date. You can cancel your subscription anytime via Google Play Store Settings.

4. User Rights & Data Ownership

Your Ownership: You retain complete ownership of all data, receipt photographs, and expense records you log in the app.
License to Use: We grant you a limited, non-transferable, revocable license to use Spence for personal, non-commercial purposes on compatible Android devices.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPENCE AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA LOSS, OR BUDGETARY DISCREPANCIES RESULTING FROM YOUR USE OF THE APPLICATION.

6. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved amicably or through binding individual arbitration.
